Jonathan Mok is an Associate in the Litigation & Dispute Resolution practice of Cavenagh Law LLP.
Jonathan has an active practice in civil litigation and international arbitration, and has experience in a broad range of disputes at all levels of the Singapore courts.
He has handled a diverse range of disputes relating to equity and trusts, complex commercial contracts and professional negligence.
In respect of contentious matters:
- Acting for a US manufacturer and operator in a wind turbine dispute relating to various onshore wind farms in Thailand. The dispute is governed by Singapore law and the SIAC Rules.
- Acted for a major Singapore oil trading company in a US$2.7 billion claim against its former auditors in negligence for failing to detect misstatements in its audited financial statements.*
- Acted for a high net worth individual from a foreign jurisdiction in a complex trust dispute involving the administration of trust assets alleged to amount to more than US$100 million. The dispute involved successfully resisting an application for stay of proceedings both at first instance and on appeal (Sullivan, Sir Cornelius Sean v Hill Capital Pte Ltd and another [2024] 5 SLR 224).*
- Acted for a hotel management conglomerate in SIAC arbitration proceedings against an Indonesian hotel owner and obtained judgment establishing breaches of a hotel management agreement in a claim for sums exceeding US$10.5 million.*
- Acted for the Estate of a high net worth individual in the United States in a dispute before the Singapore International Commercial Court concerning claims of breach of trust and fiduciary duties against a Singapore company, a Swiss individual and a Hong Kong company. The dispute involved obtaining judgment and recovery of assets exceeding US$35 million, as well as obtaining an anti-suit injunction, which was upheld by the Court of Appeal (BCS Business Consulting Services Pte Ltd and others v Baker, Michael A (executor of the estate of Chantal Burnison, deceased) [2023] 1 SLR 1), and a committal order for the failure to comply with the anti-suit injunction (Baker, Michael A (executor of the estate of Chantal Burnison, deceased) v BCS Business Consulting Services Pte Ltd and others [2024] 3 SLR 302).*
In respect of regulatory and other advisory work:
- Advised a major US insurance company on the recovery of assets in a multi-jurisdictional wire fraud.*
- Advised a Singapore company which owns various subsidiaries in South Korea, Singapore and Thailand on its disclosure obligations in cross-jurisdiction investigations by the United States Securities and Exchange Commission into its subsidiaries.*
